Definitions
The supplier means M. W. Tractors.
The customer means: the buyer of all goods and equipment, including all services sold by the supplier.
General
Concerning all matters of sales, quotes or any other services produced by the supplier, are subject to English law and all parties submit to the jurisdiction of the courts of England.
Sales
1. Ownership of all goods and equipment shall not pass to the customer until payment has been made, in full, and the supplier reserves the right to reposes all goods and equipment until such time.
2. The customer shall make payment, in full, to the supplier within 7 days of the invoice date and prior to any delivery or collection of goods or equipment.
3. Any deposits made on cancelled orders (where payment is overdue) will be non-refundable unless otherwise agreed by the supplier prior to purchase.
4. The supplier reserves the right to charge interest on all over due accounts at the rate of 2 % above bank of England base rate.
Guarantees, Warranties and Liabilities
1. Unless otherwise specified in the contract, all goods and equipment are sold in their existing condition with no guarantees or warranties given or implied, the customer having had every opportunity to view and inspect the goods and equipment.
2. The supplier will accept no liability for any loss of revenue due to faults with external equipment such as batteries; the supplier will, however, act in good conscience to avoid any such faults.
3. The supplier will accept no liability for any loss or damage sustained to the goods and equipment, on the departure from the supplier's premises (if the customer has arranged their own collection).
4. The supplier will accept no liability for any loss or damage sustained to the goods and equipment once the goods have been transferred to the customer or by any loading or unloading carried out by people who are not employed by the supplier.
Deliveries & collections
1. All Delivery dates are estimated in good faith but are approximate. The supplier (at all times) will use all ethical endeavours to adhere to estimated delivery dates, however; the Supplier cannot guarantee such dates and will not accept any liabilities or responsibilities for late delivery.
2. All purchased goods must be collected within 7 days of the day of payment and the supplier does not accept any liabilities or responsibilities for any loss, theft or damage after this time.
Returns & Refunds
1. The Supplier accept returns within 7 days of delivery or collection of all goods and equipment, however, the customer is responsible for the cost of returning any purchased goods or equipment and a refund will not be considered until such time.
2. On all refunds, a handling charge of 10% of total order value (minus the VAT for those items where VAT applies) will be deducted unless otherwise specified by the supplier prior to purchase of any goods or equipment.
3. Refunds can take up to 14 days from the day of return-delivery and will only be accepted within the specified time allowed for returns.
4. All goods and equipment, purchased by the customer, must be returned in the same condition as on the day of purchase or a refund may be rejected.
