TERMS AND CONDITIONS

Definitions

The supplier means M.W. Tractors.

The customer means the purchaser of goods.

General

Concerning all matters of sales, quotes and any other services produced by the supplier are subject to English law and all parties submit to the jurisdiction of the courts of England.

Sales

Ownership of all used vehicles, spare parts or equipment shall not pass to the customer until payment has been made in full and the supplier reserves the right to reposes all used vehicles, spare parts or equipment and have unrestricted access to any premises of the customer for such purpose.

The customer shall make payment of a 10% deposit, of total order value, on placement of any order for used vehicles, spare parts or equipment. On payment of the 10% deposit the supplier will hold the ordered items for the period of 14 days from invoice date. The deposit is non-refundable and will be lost if the order is not completed within 14 days of the invoice date.

The customer shall make payment to the supplier in full within 14 days of the invoice date and prior to delivery or collection of used vehicles, spare parts or equipment.

The supplier reserves the right to charge interest on all over due accounts at the rate of 3 % above bank of England base rate.

Guarantees, Warranties and Liabilities

Unless otherwise specified in the contract, all used vehicles, spare parts or equipment are sold in their existing condition with no guarantees or warranties given or implied, the customer having had every opportunity to view and inspect the used vehicles, spare parts or equipment.

The supplier shall have no liability to the customer for any loss of revenue due to a fault with externals such as batteries. The supplier will however act on recommended good workmanship.

The supplier shall have no liability to the customer for any loss or damage sustained to the used vehicles, spare parts or equipment, if the customer has arranged their own collection, from the moment of departure from the supplier's premises.

The supplier shall have no liability to the customer for any loss or damage sustained to the used vehicles, spare parts or equipment once the goods have been transferred to the customer or by any loading or unloading at the receiving premises carried out by people who are not employed by the supplier.
